Purchasing a firearm that is going to be exchanged with a loved one may seem like a cut-and-dry process. However, the manner in which you conduct this type of transaction should follow federal guidelines This will prevent you from committing an illegal act that could result in serious charges.

The Gift-Giving Process

If you would like to surprise a family member or friend with a recreational rifle or handgun that can be used at a shooting range, you will need to first research if this type of gun can be legally accessed in the state that you live in. Next, you will need to find out what a store owner's protocol is.

The person who will ultimately have the gun in their possession will need to register the firearm and pass a background test. A store owner will relay pertinent information about your responsibilities and the ones of the gift recipient. In most jurisdictions, it is perfectly legal for someone to gift another person a gun. This includes being eligible to purchase recreational ammunition and accessories that will be given as gifts.

A Mutual Exchange

A person who does not have knowledge of gun laws may request another person to purchase a gun on their behalf. In this type of scenario, funds would be given to the person who will be responsible for picking up the gun from a gun shop. A mutual exchange like this is not legal and is sometimes referred to as a straw gun purchase. The only way that a secondary party could legally obtain a firearm that they intend to pay for is by stopping by a gun shop and purchasing a gun themselves.

A Protection Process For Gifts

Once a gun has been given as a gift, you are essentially free from any type of responsibility that is associated with the firearm. However, if you would like to give yourself piece of mind and have valid proof that you are not the owner of a gun, drawing up paperwork will provide you with the level of protection you want.

A legal document that lists the serial number and description of a gun can be notarized. This type of document can state that you have given a gun to the other party and that the firearm is not in your possession. This type of paperwork can be used for record keeping purposes and as proof of the gun exchange.
